Sealed bids for the construction of the SANDERSVILLE 2024 CDBG WATER SYSTEM UPGRADES CDBG PF# 1139-23-326-PF-01 project shall be received by the Town of Sandersville, Mississippi at 110 East Main Street, P.O. Box 692, Sandersville, Mississippi 39477, until 10:00 A.M., local time, Tuesday, August 6, 2024, at which time they will be publicly opened and read aloud.

Principal items of work include replacement of a 6” water distribution main, replacement of water well site electrical and controls, and modifications to the chlorine building at the Town’s water well.

The above general outline of features of the work does not in any way limit the responsibility of the Contractor to perform all work and furnish all plant, labor, equipment and materials required by the specifications and the drawings referred to therein. Contract time shall be 100 consecutive calendar days from the effective date shown in the Notice to Proceed. Liquidated damages will be assessed in the amount of $500 for each consecutive calendar day the work has not achieved Final Completion. The contracted party must comply with the requirements of Build America, Buy America (BABA) Act, 41 USC 8301 note, and all applicable rules and notices, as may be amended, if applicable to the infrastructure project. Pursuant to HUD’s Notice, “Public Interest Phased Implementation Waiver for FY 2022 and 2023 of Build America, Buy America Provisions as Applied to Recipients of HUD Federal Financial Assistance (88 FR 17001)”, any funds obligated by HUD on or after the applicable listed effective dates, are subject to BABA requirements, unless excepted by a waiver.

Bidder must be qualified under Mississippi Law and show current Certificate of Responsibility issued by the Mississippi State Board of Public Contractors establishing his classification as to the value and type of construction on which he is authorized to bid. Each Bidder shall write his Certificate of Responsibility Number on the outside of the sealed envelope containing his proposal.

Proposals shall be submitted in duplicate, sealed and deposited with the town of Sandersville, Mississippi prior to the hour and date hereinbefore designated. Bids may also be submitted online prior to the hour and date designated at www.neel-schafferplans.com. The Contractor is fully responsible for the timely delivery of the sealed bids. No bidder may withdraw his bid within 90 days after the actual date of the opening thereof. Each Bidder must submit with his proposal a separate attachment stating his qualifications to perform the Work. The Statement of Qualifications shall list past projects of similar size and nature, a list of references with name and telephone number, a list of key personnel who will perform the work, and other information supporting the bidder's qualifications.

Awarding public contracts to non-resident Bidders will be on the same basis as the non-resident bidder's state awards contracts to Mississippi Contractors bidding under similar circumstances. In order to ensure that Mississippi's so-called Golden Rule is followed state law requires a non-resident bidder to attach to his bid a copy of his resident state's current laws pertaining to such state's treatment of non-resident contractors.

Each Bidder must deposit with his proposal, a Bid Bond or Certified Check in an amount equal to five percent of his bid, payable to the Town of Sandersville, Mississippi, as bid security. Bidders shall also submit a current financial statement, if requested, by the Town of Sandersville, Mississippi. The successful bidder will be required to furnish a Payment Bond and Performance Bond each in the amount of one hundred percent (100%) of the contract amount.

The successful bidder must comply with Section 3 of the HUD Act of 1968 and its associated regulations (24 C.F.R., Part 75). CDBG regulations governing the grant require that, to the greatest extent feasible opportunities for contracting, subcontracting, training and employment arising in connection with this CDBG project will be extended to Section 3 businesses, Targeted Section 3 Workers and Section 3 Workers.
